Bankruptcy

Falling behind on your bills for one month is stressful on its own, but it can easily lead to several months of late payments, using credit cards to make up the difference and even missing mortgage payments when there is no end in sight to your debt issues.

As Cincinnati bankruptcy lawyers, we at The Law Offices of Arnold S. Levine help people address the burden of debt they face by helping them file bankruptcy. We represent clients throughout Ohio and Kentucky who need to stop foreclosures, stop wage garnishments, end creditor harassment and otherwise find solace and relief to get back on their feet.

What Type Of Bankruptcy Should I File?

The type of bankruptcy chapter you pursue will depend on your unique financial situation.

If you are struggling with unsecured debts and have a relatively low level of income and assets, Chapter 7 Bankruptcy is likely to be your best option. If you qualify for Chapter 7, your assets are collected, liquidated and distributed amongst your creditors by a bankruptcy trustee, with remaining debts discharged in a relatively short period of time. Most people who qualify do not have any assets liquidated as they are saved through bankruptcy exemptions.

If you have a steady income and are seeking to save your valued assets, such as your home, Chapter 13 Bankruptcy is more likely to work in your favor. In this situation, your debts will be restructured into a manageable payment plan that is completed within three to five years, with any remaining debts then discharged.

We will take the time to walk you through the process and determine whether or not bankruptcy is right for you. We will only recommend moving forward if it is truly in your best interest.
